AN ACT requiring the department of environmental services to bear certain clean-up costs.

ANALYSIS

This bill requires the state to pay the costs of closing or remediating a landfill when the security required by the department of environmental services is inadequate to cover the costs, or the permitee fails to perform its obligations.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand One

AN ACT requiring the department of environmental services to bear certain clean-up costs.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; State Indemnification. Amend RSA 149-M:9 by inserting after paragraph X the following new paragraph:

X-a In the event the security guaranteeing the cost of facility closure is inadequate or the permitee fails to perform its obligations the state shall indemnify the municipality against costs associated with the closure or remediation of environmental harm occasioned by the solid waste facility and shall pay the costs of any such closure or remedial action.

3 Effective Date. This act shall take effect 60 days after its passage.
