AN ACT requiring that land transferred to the White Mountain National Forest and the Silvio O. Conte National Fish and Wildlife Refuge include a covenant granting access to the citizens of New Hampshire.

ANALYSIS

This bill requires that future land transfers to the White Mountain National Forest and the Silvio O. Conte National Fish and Wildlife Refuge include a covenant granting access to the citizens of New Hampshire. The covenant shall require continued multiple-use management of the land and prohibit the designation of roadless areas within the parcel without the state's consent.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand One

AN ACT requiring that land transferred to the White Mountain National Forest and the Silvio O. Conte National Fish and Wildlife Refuge include a covenant granting access to the citizens of New Hampshire.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Sections; Required Covenants in Land Transfers to the White Mountain National Forest and the Silvio O. Conte National Fish and Wildlife Refuge. Amend RSA 121 by inserting after section 8 the following new sections:

121:9 Required Covenants in Land Transfers to the White Mountain National Forest. The purchase agreement for any new national forest lands shall include a covenant granting access to New Hampshire citizens. The purchase agreement also shall require continued, multiple-use management of such land and prohibit the designation of roadless areas within the land parcel, unless the department of resources and economic development and the governor and council agree to the designation.

121:10 Required Covenants in Land Transfers to the Silvio O. Conte National Fish and Wildlife Refuge. The purchase agreement for any lands to be included in the Silvio O. Conte National Fish and Wildlife Refuge shall include a covenant granting access to New Hampshire citizens. The purchase agreement also shall require continued, multiple-use management of such land and prohibit the designation of roadless areas within the land parcel, unless the department of resources and economic development and the governor and council agree to the designation.

2 Effective Date. This act shall take effect 60 days after its passage.
