AN ACT relative to funding of special education.

This bill provides that a school district shall be liable for a 2/3 proportional share of special education costs as provided under the Individuals with Disabilities Education Act, provided that a school district's 2/3 proportional share of special education costs in each fiscal year shall be calculated in proportion to the amount of federal funds received in each fiscal year.

AN ACT relative to funding of special education.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Special Education; Proportional Funding of Special Education by School Board. Amend RSA 186-C by inserting after section 18 the following new section:
186-C:18-a Proportional Funding for Special Education. Notwithstanding the provisions of RSA 186-C:18, a school district shall be liable for a 2/3 proportional share of special education costs as provided under the Individuals with Disabilities Education Act, 20 U.S.C. 1401, et seq., provided that a school district's 2/3 proportional share of special education costs in each fiscal year shall be calculated in proportion to the amount of federal funds received in each fiscal year. Nothing in this section shall prohibit a school district from raising funds in excess of its 2/3 proportional share of special education costs.
2 Effective Date. This act shall take effect 60 days after its passage.

AN ACT relative to funding of special education.
FISCAL IMPACT:
The Department of Education indicates it is unable to determine the impact of this bill on state and local revenue and expenditures. There will be no fiscal impact on county revenue and expenditures.
METHODOLOGY:
The Department states this bill requires that a school district shall be liable for a two-thirds proportional share of special education costs as provided under the Individual's with Disabilities Education Act. The two-thirds share shall be based upon the amount of federal funds received for the special education costs; the federal amount will equal one-third of the total cost.
The Department further states this bill does not provide enough information to correctly provide a fiscal estimate. The Department indicates this bill is in violation of the code of federal regulations in regard to a school district's duty to provide a free and appropriate education to disabled pupils, as outlined in the Individuals with Disabilities Education Act.
