HOUSE BILL 1590
AN ACT relative to prohibiting a zoning ordinance from a residential preexisting nonconforming property owner's ability to rebuild after a fire loss.

This bill requires that for the purpose of acquiring a mortgage, no municipal zoning ordinance shall prohibit a residential preexisting nonconforming use property from the ability to rebuild after a fire loss.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand
AN ACT relative to prohibiting a zoning ordinance from a residential preexisting nonconforming property owner's ability to rebuild after a fire loss.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Certain Nonconforming Properties; Ability to Rebuild. Amend RSA 674 by inserting after section 19 the following new section:
674:19-a Certain Nonconforming Properties; Ability to Rebuild. For the purpose of permitting an owner to acquire a mortgage on a property, no municipal zoning ordinance shall prohibit a residential preexisting nonconforming use property from the ability to rebuild the same structure after a complete fire loss, subject to other applicable health and safety regulations.
2 Effective Date. This act shall take effect 60 days after its passage.
