STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand

AN ACT requiring teachers and school administrators to report incidents of disruptive behavior by students.

Be it Enacted by the Senate and House of Representatives in General Court convened:

194:1 Reporting Requirements; Child Endangerment; Assaults. Amend RSA 193-D:4, I (a) to read as follows:

I.(a) Any public or private school employee who has witnessed or who has information from the victim of an act of theft, destruction, or violence in a safe school zone shall report such act in writing immediately to a supervisor. A supervisor receiving such report shall immediately forward such information to the school principal who shall file it with the local law enforcement authority. Such report shall be made by the principal to the local law enforcement authority immediately, by telephone or otherwise, and shall be followed within 48 hours by a report in writing. If the alleged victim is a student, the principal shall also immediately notify the person responsible for the victim's welfare, as defined in RSA 169-C:3, XXII, that a report was made to the local law enforcement authority.

194:2 Effective Date. This act shall take effect January 1, 2001.

HB 683-FN - FISCAL NOTE

AN ACT requiring teachers and school administrators to report incidents of disruptive behavior by students.

FISCAL IMPACT:

The Department of Education indicates this bill may increase local expenditures by an indeterminable amount beginning in FY 2000 and each year thereafter. There will be no fiscal impact on state, county and local revenue or state and county expenditures.

METHODOLOGY:

The Department states this bill adds criminal threatening to the definition of theft, destruction or violence. Since the offense may require a hearing by the local school board prior to reinstatement, the bill may result in additional school board hearing expenditures.
