STATE OF NEW HAMPSHIRE

In the Year of Our Lord One Thousand Nine Hundred and Ninety-Nine

AN ACT requiring all postsecondary institutions to report all assaults to local police departments.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Reporting Requirement Applicable to Postsecondary Institutions. Amend RSA 193-D:4, I(a) to read as follows:

(a) Any public or private school employee of any school as defined in RSA 193-D:1, III and any employee of any public or private postsecondary institution who has witnessed or who has information from the victim of an act of theft, destruction, or violence in a safe school zone shall report such act in writing immediately to a supervisor. A supervisor receiving such report shall immediately forward such information to the school principal, or, in the case of a postsecondary institution, the head administrative officer of the institution, who shall file it with the local law enforcement authority. Such report shall be made by the principal or head administrative officer to the local law enforcement authority immediately, by telephone or otherwise, and shall be followed within 48 hours by a report in writing. Such reports shall be public records, except the identity of a minor being charged or investigated shall not be revealed, and shall be compiled and made available to the public on a quarterly basis.

2 Effective Date. This act shall take effect January 1, 2000.
